The legal technicality to end all legal technicalities

Now if I am understanding this story correctly, convicted polygamist sect leader and rapist Warren Jeffs is now seeking to have the incest charges against him dismissed — not because he says it didn’t happen, but because in Arizona, the law against incest applies to cases where the involved individuals are over the age of 18. Of course, in the case of Jeffs, his victims were minors.

That’s….something.

I don’t understand something. The Christian fundamentalists in this country are always complaining that their First Amendment rights are being violated because their school teachers cannot teach their theology to the students in their classes, who have probably learned another theology in their own churches and synagogues. They claim that their First Amendment right of “free exercise of their religion” is being trampled because this witnessing is what their faith requires them to do. By that very same argument, Warren Jeff’s church has a right to the “free exercise of their religion” too. Their religion just happens to require them to enter into multiple marriages and have sex with under-aged girls. However, I dare say there is not a Southern Baptist fundamentalist (Oh yes you are too!!!) anywhere in East Tennessee who is not in favor of sending the police in to rescue those girls from the fundamentalist LDS church. Therefore, in terms of legal rights, I do not understand why a lawsuit to protect my United Methodist children from the classroom rantings of a Separate Baptist science teacher would not be equally justified. I think it would be perfectly justified. Under the first amendment, you have a free right to exercise your religion, but this amendment does not grant you the right to a captive audience.
